This statute authorizes the Council of Juvenile and Family Court Judges to create a program that reimburses counties for the costs of mental health evaluations and examinations ordered for juveniles charged with felony offenses, as well as costs for transporting juveniles for these evaluations and detention costs. The program operates only if state funding is available.

(a) The council of juvenile and family court judges is authorized to establish and administer a program to reimburse counties for the costs associated with inpatient mental health evaluations and examinations conducted on juveniles charged with an offense which would constitute a felony if committed by an adult. Such a program is subject to available state funding and may include full or partial reimbursements to counties for the costs of inpatient mental health examinations or evaluations ordered by a juvenile court judge, as well as the costs of transportation of the child for a mental health examination or evaluation. The program may also include reimbursement to counties for costs of detention incurred pursuant to § 37-1-116(f) for the purposes of obtaining an outpatient evaluation or examination at a detention facility located in another county. (A) A person under eighteen (18) years of age. See Tennessee Code 37-1-102Detention: means temporary confinement in a secure or closed type of facility that is under the direction or supervision of the court or a facility that is designated by the court or other authority as a place of confinement for juveniles. See Tennessee Code 37-1-102Juvenile court: means the general sessions court in all counties of this state, except in those counties and municipalities in which special juvenile courts are provided by law, and "judge" means judge of the juvenile court. See Tennessee Code 1-3-105(b) The council may adopt rules and regulations governing such a reimbursement program pursuant to § 37-1-502.
