What does this charge mean?
It is illegal to distribute or deliver any substance while claiming it is (or creating the false belief that it might be) a biological, chemical, nuclear, or radiological weapon, either as an actual terrorist act or as a hoax. If done as a terrorist act, it is a Class A felony (15-60 years); if done as a hoax, it is a Class C felony (3-15 years), and in either case the offender must pay restitution to cover the costs incurred by government or private entities responding to the threat.

(a) It is an offense for any person to distribute or to deliver, as an act of terrorism or as a hoax, any substance that is intended to, or that such person has reason to believe may, create a fear or apprehension on the part of any other person that such substance may be a biological warfare agent, a chemical warfare agent, or a nuclear or radiological agent, without regard to whether such substance is in fact a biological warfare agent, chemical warfare agent, or a nuclear or radiological agent. (A) Intimidate or coerce a civilian population. See Tennessee Code 39-13-803Person: includes the singular and the plural and means and includes any individual, firm, partnership, copartnership, association, corporation, governmental subdivision or agency, or other organization or other legal entity, or any agent or servant thereof. See Tennessee Code 39-11-106Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.(b) (1) A violation of subsection (a) as an act of terrorism is a Class A felony. (2) A violation of subsection (a) as a hoax is a Class C felony. (c) In addition to the penalties otherwise provided by law, any person convicted of a violation of subsection (a), either as an act of terrorism or as a hoax, shall make restitution of the costs incurred by any public or private entity or person resulting from such offense.
