(a) A person or an entity commits an offense if the person or entity knowingly: (1) Uses a telephone or other communication or electronic device to obtain information concerning the medical condition or health of an elderly adult; (2) Sends, or causes to be sent, medical supplies, medical equipment, or medicine to the elderly adult and the items sent are unsolicited or specifically refused; and (3) Files a claim or submits a bill with the state medicaid plan for reimbursement of the value of the equipment, supplies, or medicine sent to the elderly adult. (b) Any person who violates this section shall be punished as provided in § 71-5-2601(a)(4).
