The commissioner of mental health and substance abuse services, upon the agreement of the commissioner of health, shall place a substance in Schedule II upon finding that: (1) The substance has high potential for abuse; (a)(38) or a specific statute exists covering the same or similar conduct. See Tennessee Code 39-11-106United States: includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105(2) The substance has currently accepted medical use in treatment in the United States, or currently accepted medical use with severe restrictions; and (3) The abuse of the substance may lead to severe psychic or physical dependence.
