The commissioner of mental health and substance abuse services, upon the agreement of the commissioner of health, shall place a substance in Schedule V upon finding that: (1) The substance has low potential for abuse relative to the controlled substances listed in Schedule IV; (a)(38) or a specific statute exists covering the same or similar conduct. See Tennessee Code 39-11-106United States: includes the District of Columbia and the several territories of the United States. See Tennessee Code 1-3-105(2) The substance has currently accepted medical use in treatment in the United States; and (3) The substance has limited physical dependence or psychological dependence liability relative to the controlled substances listed in Schedule IV.
