Copies of minutes – New indictment
PENDINGUnknown
What does this charge mean?
This statute allows courts to use copies of court minutes as valid replacements if original documents are lost, destroyed, or stolen. If an indictment was never properly recorded in court minutes as required by TCA 40-13-109, the court can order a new indictment to be filed at the same court session or a later one, after the loss or destruction is proven. No criminal penalty applies—this is a procedural remedy.
