An offender convicted of any of the following offenses is ineligible to participate in the special alternative incarceration program: (1) Class A felony; (2) Aggravated robbery; (3) An offense involving sexual contact or sexual penetration, as defined in § 39-13-501; (4) An offense involving child abuse, child sexual abuse, or sexual exploitation of a minor; (5) An offense involving the illegal distribution or sale of a controlled substance or controlled substance analogue to a minor; (6) An offense involving serious bodily injury, as defined in § 39-11-106; or (7) An offense involving death to a victim or bystander.
