(a) Tennessee comprehensive assessment program (TCAP) tests may be administered to students in a timed format. The department of education shall establish the required time limit for each TCAP test and an optional additional time period that may be added to the required time limit for each test if requested by a student. Ask a legal question, get an answer ASAP!(b) A test administrator may provide the additional time period at the request of the student or a parent of the student. The optional additional time period must be used consecutively to the required time limit for each test. Notwithstanding this section to the contrary, the administrator shall not provide the optional additional time period if the optional additional time period would invalidate the results of the test. (c) This section does not supersede an LEA or public charter school’s obligation to comply with the federal Individuals with Disabilities Education Act ( 20 U.S.C. § 1400 et seq.), or Section 504 of the Rehabilitation Act ( 29 U.S.C. § 794 ).
