Prohibited acts

A postsecondary educational institution, alone or in concert with any person, agent, group, or entity, shall not: (1) Operate a postsecondary educational institution in this state that is not exempted from this part, unless the postsecondary educational institution has a current and valid authorization issued pursuant to this part; Ask a legal question, get an answer ASAP!(2) Offer as, or through an agent, enrollment or instruction in, or the granting of educational credentials from, a postsecondary educational institution outside this state that is not exempted from this part, unless the postsecondary educational institution has a current and valid authorization issued pursuant to this part; (3) Instruct or educate, or offer to instruct or educate, including advertising or soliciting for such purpose; enroll, or offer to enroll; contract, or offer to contract, with a person for such purpose; or award an educational credential or contract with an institution or party to award an educational credential in this state, regardless of whether the agent or postsecondary educational institution is located within this state, unless the agent or postsecondary educational institution observes and is in compliance with the minimum standards set forth in § 49-7-2006(a), the standards established by the commission pursuant to § 49-7-2005(a)(1), and the rules promulgated by the commission pursuant to § 49-7-2005(a)(6); (4) Use “university” or other terminology, without authorization to do so from the commission, that could mislead the general public; or (5) Grant, or offer to grant, educational credentials, unless the postsecondary educational institution has a current and valid authorization issued pursuant to this part.
