Rape is non-consensual sexual penetration accomplished through force, coercion, fraud, or when the victim is mentally incapacitated, mentally defective, physically helpless, or a vulnerable adult with an intellectual disability. This offense occurs when someone engages in sexual penetration without the other person's consent or when consent is impossible due to the victim's condition. Conviction carries 8 to 30 years in prison and fines up to $25,000.

Penalty: Class B felony; 8-30 years; fine up to $25,000

Sexual battery is unwanted sexual contact (touching of intimate parts or clothing covering intimate areas) accomplished through force, coercion, fraud, or when the victim is mentally incapacitated, mentally defective, or physically helpless. This is the less severe sexual offense not involving penetration. Conviction carries 1 to 6 years in prison and fines up to $3,000.

Penalty: Class E felony; 1-6 years; fine up to $3,000

It is illegal to sexually penetrate a child who is more than 8 years old but less than 13 years old. This is a Class A felony punishable by 15-60 years in prison with a mandatory minimum sentence in Range II (a sentencing guideline range). The court cannot impose a sentence lower than Range II. Additionally, the board of parole may require satellite-based monitoring (GPS tracking) for the entire supervision period.
